Terms of Use

These terms of use apply to the NeonFuel app (hereby referred to as "Application") for mobile devices, created by Daniil Martynov (hereby referred to as "Service Provider") as a subscription-based service. This service is provided "AS IS".

By downloading or using the Application, you agree to these terms. Please read them carefully before using the Application.

License and Restrictions

The Service Provider grants you a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Application. Reverse engineering, decompiling, or extracting source code is prohibited. All intellectual property rights remain with the Service Provider.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account and device security. The Service Provider advises against jailbreaking or rooting your device, as this may compromise security and affect Application functionality.

Free Trial

New users may access premium Application features during a free trial period. The duration of the free trial is displayed at the time of subscription initiation within the App Store. Access to AI-powered features during the free trial may be subject to applicable usage limits, rate limits, or fair use restrictions.

The free trial is offered through Apple's App Store and is subject to Apple's terms and conditions, including eligibility requirements and auto-renewal policies. Trial availability, duration, cancellation procedures, and any conversion to a paid subscription are governed solely by Apple. The Service Provider has no control over and makes no representations regarding Apple's subscription management processes.

The Service Provider reserves the right to modify or discontinue the free trial offer at any time.

Subscription and Payments

Following the free trial period, continued access to premium Application features requires an active paid subscription. All subscriptions are processed exclusively through Apple's App Store and are subject to Apple's payment terms, billing cycles, cancellation policies, and refund policies. The Service Provider does not process payments directly and has no access to your payment information.

Subscription pricing is displayed prior to purchase within the App Store and may vary by region and currency. You can manage, modify, or cancel your subscription at any time through your Apple ID account settings. The Service Provider reserves the right to update subscription offerings with reasonable advance notice.

Access Without an Active Subscription

Users without an active free trial or paid subscription retain access to basic Application functionality only. Basic functionality includes: viewing your account profile and settings, accessing previously logged meal data, reviewing your historical nutrition records, and managing your account. Features requiring AI processing — including but not limited to AI food analysis, AI coaching, AI-generated nutrition recommendations, and meal generation — are exclusively available to users with an active free trial or paid subscription.

AI Features Disclaimer

The Application includes AI-powered features for nutrition analysis and coaching, available exclusively during an active free trial or paid subscription and subject to usage limits, rate limits, and fair use restrictions determined by the Service Provider. These limits may change from time to time. While we strive for accuracy, AI-generated content is for informational purposes only and should not replace professional medical or nutritional advice. The Service Provider is not liable for decisions made based on AI recommendations.

Health Information Disclaimer

The Application provides general nutrition tracking and guidance. It is not a medical device and does not provide medical diagnoses, treatment recommendations, or professional dietary advice. Consult a healthcare professional before making significant changes to your diet or if you have health concerns.

Third-Party Services

The Application utilizes third-party services including Apple (Sign-In, HealthKit, App Store), OpenAI, InstantDB, Sentry, RevenueCat, and Expo. These services have their own terms and conditions that may apply to your use of the Application.

Internet Connectivity

Many Application features require an active internet connection. The Service Provider is not responsible for limited functionality due to lack of connectivity or data charges incurred from your mobile provider.

Service Availability

The Service Provider strives to maintain Application availability but does not guarantee uninterrupted access. The Application may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

Limitation of Liability

To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Application.

Updates and Changes

The Service Provider may update the Application and these Terms at any time. Continued use after changes constitutes acceptance. The Service Provider may discontinue the Application with reasonable notice when possible.

Termination

The Service Provider may terminate your access for violation of these terms. Upon termination, your license ends and you must stop using and delete the Application.
